聲明/新聞稿 : 媒改團體呼籲：政院立即兩階段修公視法--董事會人數合理化，全盤修改公視法

對於公視第五屆董事會長期難產，及公視發展陷入停滯，公民團體今日（22日）持續於行政院前陳情抗議，並於午間會見文化部長龍應台，籲請主管機關立即修法，讓已當選之第五屆公視董事立即就任，解決第四屆董事不當延任超過兩年的鬧劇。
我們將於明日起，要求行政院與朝野政黨立即負起責任，提出解決方案，以兩階段修法，真正落實「公視屬於全民」的公視法精神：
一、 立即修改「林益世條款」，降低公視董事會人數為11至15人
公視法原規定董事人數即為11至15人，2008年國民黨籍立委林益世提出修法，將董事人數增加至17至21人。我國公視規模（每年總經費約12億）遠低於英國BBC與日本NHK（每年經費皆各約台幣2000億），但董事會人數反倒遠高於這兩家享譽國際的公共電視台（皆為12人），設計顯有不當，因此外界猜測執政黨藉當時藉此企圖影響公視運作。
因此我們認為，當前公視困局的最快作法，就是由執政黨與行政院負起責任，提單一條文修法，恢復董事名額至原本的11到15人，而立院則應召開臨時會通過。如此則目前已經已經產生的13位董事，便能立即組成第五屆董事，立即解決公視董事會困局，並促成公視董事會規模合理化。
二、 展開公視法全盤修法，擴大公視之公共服務範疇
因為公視第五屆董事長期難產，社會普遍認為制度設計必須修正。然而，許多人卻僅聚焦於董事產生程序或門檻，但事實上，未能釐清董事會權責定位混亂，以及公視資源配置失當及規模不足，才是近年台灣公廣制度發展停滯的根源。因此我們主張，行政院與朝野政黨儘速展開公視法相應之全盤修正，包括以下三項重點，以促成公視良善發展，負起公共服務與導正台灣媒體產業結構之責：
(1) 建立公廣集團：保障並擴大財務基礎，整合現有公視、華視、客台、原視、宏觀等公共廣電媒體資源，建立統合治理與財務架構，發揮綜效，實現公共廣電服務任務。
(2) 強化內部治理效率，釐清監督管制（董事會）與經營管理（執行長）之權責分工。確立董事會性質，增加董事之公眾代表性以及提名審查過程之公開性。
(3) 落實公共問責與公眾參與，董事會需主動蒐集公眾意見，並公開向社會及立法院提出年度自我工作與評估報告。擴大公共服務範圍，包含特殊服務（如族群或兒少、藝文）、數位平台、海外服務等。
